1. Introduction and Acceptance of Terms

Welcome to Oleant.net Website Auditor (the "Service"), owned and operated by Oleksii Antoniuk (the "Service Provider," "We," "Us," or "Our"). These Terms of Use ("Terms") govern your access to and use of the Service, including any content, functionality, and services offered on or through Oleant.net (the "Website").

By accessing or using the Service, whether as an unregistered or registered user, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

The Service is designed to provide website auditing capabilities, primarily based on Lighthouse CLI reports. Our audits offer structured data on various metrics, including but not limited to Performance, SEO, Accessibility, and Best Practices in HTML. Users may download the generated audit reports in PDF format.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice at any time.

2.1. Website Auditor Widget (Lighthouse Certified Widget)

The Service offers an optional "Lighthouse Certified Widget" (the "Widget") that users can embed on their websites. The Widget is designed to display a simplified, real-time representation of the website's latest Lighthouse audit data.

  • Functionality: The Widget fetches and displays key performance metrics (Performance, Accessibility, Best Practices, and SEO scores) for the associated domain. The displayed data is based on the most recent audit conducted by the Service.

  • Data Refresh: The audit data displayed by the Widget is updated periodically (e.g., once every 24 hours). The Widget itself does not initiate a new audit; it only reflects the results of the last completed audit.

  • Embedding: By embedding the Widget code on your website, you consent to the Widget making an API request to the Service to retrieve audit data. This data retrieval is limited to displaying the audit results on your website and does not collect any personal data from your website's visitors.

  • Third-Party Use: You are responsible for ensuring that the embedding of this Widget on your website is compliant with all applicable laws and regulations, including but not limited to any necessary disclosures to your website users regarding the use of third-party services.

  • Disclaimer: The audit data provided by the Widget is for informational purposes only. The Service Provider is not liable for any discrepancies, inaccuracies, or performance issues that may arise from the use or display of the Widget.

3. User Accounts and Access Tiers

3.1. Unregistered Users (Guests)

For unregistered users (also referred to as "guests"), the Service offers the possibility to conduct a single free session-based audit ("Free Session Audit"). Upon completion of a Free Session Audit, the resulting PDF report will be delivered to the email address specified by the user. Please note that PDF reports provided to unregistered users may contain visible watermarks, indicating their status as preliminary or sample versions. To receive this report and utilize the Free Session Audit feature, users must explicitly accept these Terms of Use and our Privacy Policy.

3.2. Registered Users

Users may opt for quick registration directly from the email report delivery form. Registration provides enhanced functionalities, including:

  • The ability to generate up to five (5) free audits within a twenty-four (24) hour period.

  • Access to a personal dashboard/account ("Personal Cabinet") to review and manage the history of generated audit reports.

  • Access to PDF reports without watermarks, providing a full, unobstructed view of the audit results.

To access your registered account, you must use your unique login credentials, consisting of your email address and a password. In the event of a forgotten password, a password recovery mechanism is provided to regain access to your account.

3.3. Account Security

You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. User Responsibilities and Prohibited Uses

As a user of the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of any international, federal, provincial, or state regulations, rules, laws, or local ordinances.

  • Solicit others to perform or participate in any unlawful acts.

  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

  • Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

  • Submit false or misleading information.

  • Upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.

  • Collect or track the personal information of others without their consent.

  • Spam, phish, pharm, pretext, spider, crawl, or scrape.

  • Interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

  • Audit websites without explicit authorization from their respective owners. Any unauthorized auditing may lead to account suspension or termination.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Oleksii Antoniuk and its licensors. The Service is protected by copyright, trademark, and other laws of both Germany and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Oleksii Antoniuk.

By submitting URLs for auditing, you represent and warrant that you have the necessary rights or permissions to conduct such audits. You retain all ownership rights to the data and content you submit to the Service. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute such data and content solely for the purpose of providing and improving the Service to you.

6. Disclaimer of Warranties; Service "As Is"

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. THE SERVICE PROVIDER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR THAT ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

WE DO NOT WARRANT THAT THE AUDIT REPORTS WILL BE FREE OF DEFECTS, OR THAT THEY WILL LEAD TO SPECIFIC IMPROVEMENTS OR OUTCOMES FOR YOUR WEBSITE. THE REPORTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED AS PROFESSIONAL ADVICE.

7. Limitation of Liability

IN NO EVENT SHALL THE SERVICE PROVIDER, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

The Service Provider shall not be liable for any direct or indirect damage or loss whatsoever caused by the use or reliance on any audit reports generated by the Service.

8. Termination and Account Deletion

You may terminate your account at any time by utilizing the self-service account deletion feature available in your Personal Cabinet. Upon account deletion, all your associated data and audit report history with the Service will be permanently erased, WITHOUT ANY POSSIBILITY OF RESTORATION OF THE FORMED REPORTS OR HISTORICAL DATA.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be settled by negotiation in good faith. If the dispute cannot be resolved through negotiation, the parties agree to submit to the exclusive jurisdiction of the courts located in Germany.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

11. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding our Service and supersede and replace any prior agreements, oral or otherwise, regarding the Service.

  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

  • Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
